Applied to criminal law, these words from Terence remind us that this law can only be thought of through the prism of the human, going against current policies which pursue a more security logic. Alternatives to incarceration, restorative justice or even transformations undergone by criminal liability: this work intends to highlight contemporary developments and demonstrate that criminal law must be built around man. Mixing humanism and criminal law thus constitutes a way of resisting to not forgetting that humanism constituted, upon the entry into force of the current penal code, an anchor point for the modern criminal law.
